Fines or criminal prosecution for breach of quarantine

Businesses can receive a fine of up to CZK 3 million for non-compliance with emergency measures

On Thursday, 12 March 2020, the government of the Czech Republic declared a state of emergency in connection with the proven occurrence of coronavirus in the country. The obligation of natural persons and legal entities to comply with government regulations and other extraordinary measures is established by Act No. 258/2000 Coll., on Protection of Public Health. If found to be in breach of these regulations and measures, natural persons, legal entities and natural persons conducting business are subject to the following penalties in the form of fines or imprisonment:

  • Natural persons are subject to a fine of up to CZK 20,000 for breaching the obligation to comply with restrictions arising from the crisis measures and a fine of up to CZK 2 million for breaching the obligation to refrain from prohibited activities.
  • Legal entities and natural persons conducting business are subject to a fine of up to CZK 3 million for breaching the obligations set forth above.
  • Pursuant to the Act on Protection of health, a fine of up to CZK 3 million may be imposed for breach of quarantine.
  • The government has classified coronavirus (COVID-19, SARS-COV-2) as an infectious disease and, in addition to financial penalties, violators may be subject to criminal prosecution for the crime of spreading an infectious disease pursuant to Sections 152 and 153 of the Criminal Code. Deliberately spreading the virus may be punishable by imprisonment for a period of up to twelve years.
